Española Farmers Market Rules and Regulations
1. Farmers will be allowed to sell only produce grown or gathered themselves in the county of Rio Arriba or contiguous counties (Los Alamos, Santa Fe, & other neighboring counties). Exceptions may be made at the manager’s discretion in consultation with the Market Board for specialty items that would benefit the market.
2. Limited amounts of produce from neighboring farms may be sold by farmers on a temporary basis at the discretion of the Market Manager. No other reselling is permitted.
3. Processed foods with primary ingredients grown or gathered within the region may be sold. Food processors must obtain all required state and county health permits and /or must attend all required classes. Española Farmers Market accepts no responsibility or product liability for processed foods sold at the market.
4. Nursery crops & fresh or dried flowers may be sold with an individual nursery license. Vendors must comply with all state laws and regulations.
5. Only craft items which are grown, gathered, and manufactured by the seller with local natural materials such as dried chile, lavender, herbs, grasses, gourds, beeswax or other may be sold at the market. Exceptions may be made at the manager’s discretion in consultation with the Market Board for specialty items that would benefit the market.
6. Farmers must agree to allow a farm inspection by market management in the event a question of product origin arises. A phone call or written notice will be given before inspection is made.
7. The market manager has the authority to require a vendor to remove infested produce from the market.
8. All sellers are required to display a clearly visible sign bearing their farm name and location.
9. Each market space must be no more than 100 square feet with the frontage limited to 10 linear feet. Vendors who occupy more space will be charged an additional booth fee based on the amount of space occupied.
10. Only those sellers authorized to do so by the Market Manager may accept WIC Farmers Market Nutrition Program (FMNP) or Senior WIC. Consult the manager to register for this program.
11.The fee for selling at the Espanola Farmers Market is $15–$30 sliding scale per market day, collected by the market manager.
12. No more than two (2) vendors may provide lunch services at the market for a rate of $25, plus booth fee. Food vendors need to confirm with us the Friday before market if they will be vending that Monday.
13. Market Manager will assign spaces. Vendors are to arrive between 7 and 8am to set up. Farmers with a permanent space assignment must call the market manager by 8pm the evening before the market if they are unable to attend the next day or if they will be arriving late. Vendors are required to clean up their space before they leave for the day.
